Terms and Conditions
These Terms and Conditions accompany and form part of the Nippersink Lodge Lodging Policy. The Lodging Policy describes how we operate; these terms set out the legal basis of your stay. Please read them together.
Agreement to These Terms
By completing a reservation, checking in, or staying at Nippersink Lodge, you confirm that you have read and accepted these Terms and Conditions and the Lodging Policy, on behalf of yourself and everyone in your party. If you do not agree, please do not complete your reservation.
Assumption of Risk
Nippersink Lodge is a historic 1935 lodge set directly on Little River. You voluntarily accept the inherent risks of staying at a historic riverfront mountain property, and of the facilities, conditions, and activities described in the Lodging Policy, for yourself.
Release of Liability
To the fullest extent permitted by Alabama law, you release and agree not to sue Nippersink Lodge LLC, its owners, innkeepers, employees, and agents for any injury, illness, loss, damage, or death to you arising from your stay, your use of the property and its facilities, or any activity on or from the property, except where caused by the Lodge’s gross negligence or willful misconduct.
Limitation of Liability
To the fullest extent permitted by Alabama law, Nippersink Lodge LLC, its owners, innkeepers, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from your reservation or stay. Our total liability for any claim will not exceed the total amount you paid for your reservation.
Indemnification
You agree to defend, indemnify, and hold harmless Nippersink Lodge LLC, its owners, innkeepers, employees, and agents from any claims, damages, losses, costs, and expenses, including reasonable attorney fees, brought by a third party or by a minor in your care, arising from the acts, omissions, or conduct of you, your children, your guests, or anyone you bring to or invite onto the property.
Personal Property
Nippersink Lodge is not responsible for the loss of, theft of, or damage to guests’ money, valuables, or other personal property brought onto the property, except to the extent required by Alabama law.
Right to Refuse or End a Stay
Consistent with Alabama law, we reserve the right to refuse service, or to end a stay, for conduct that endangers, threatens, or unreasonably disturbs guests, staff, or the property.
Dispute Resolution and Binding Arbitration
Any dispute arising out of or in connection with these Terms and Conditions, your reservation, or your stay will be resolved through binding, individual arbitration administered by the American Arbitration Association under its applicable rules, rather than in court. Claims must be brought in your individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. Each party will bear its own arbitration fees and costs, except as the AAA’s rules or Alabama law otherwise require. Either party may instead bring an individual claim in small claims court. The arbitration will take place in DeKalb County, Alabama, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. This arbitration agreement does not apply to a claim brought by a minor in their own right, to the extent such a claim cannot lawfully be subjected to arbitration under Alabama law.
Severability
If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining parts will stay in full force and effect.
Governing Law
These Terms and Conditions and your reservation are governed by the laws of the State of Alabama.
